Terms of Use

Please read these terms carefully before using our services.

These Terms of Use ("Terms") govern your access to and use of the AgLoans.com website, subdomains, applications, intake forms, calculators, downloadable materials, content, and related services (collectively, the "Site"), operated by AgLoans, LLC, a Kansas limited liability company ("AgLoans," "we," "us," or "our").

By accessing or using the Site, by submitting an inquiry or intake form through the Site, or by otherwise communicating with us in response to Site content, you agree to these Terms and to our Privacy Policy, which is incorporated by reference.

IF YOU DO NOT AGREE, DO NOT USE THE SITE AND DO NOT SUBMIT INFORMATION TO US.

1. Definitions

  • "Site" means the AgLoans.com website and all related pages, forms, tools, calculators, downloadable content, applications, and communications channels operated by AgLoans.
  • "You" or "User" means any person or entity accessing the Site or submitting information through it.
  • "Lender Partners" means independent third-party lenders, banks, Farm Credit institutions, credit unions, correspondent lenders, licensed brokers, financing providers, investor programs, and similar entities that may receive your information and may contact you.
  • "Referral Partners" means independent third parties who refer prospective borrowers to AgLoans under a separate written agreement with AgLoans.
  • "Inquiry" or "Submission" means any information you provide through the Site, by phone, by email, by text, or through any other channel, including intake forms, document uploads, and consultation requests.
  • "Business-Purpose / Agricultural-Purpose Financing" means financing sought primarily for business, commercial, agricultural, ranching, or farming purposes — and not for personal, family, or household purposes.
  • "Lender-Ready Package" means a compiled set of documents and information that you provide or authorize us to collect, organized for your convenience and for presentation to one or more Lender Partners.

2. What AgLoans Does — And Does Not Do

AgLoans provides marketing, borrower education, intake, document collection, package organization, and routing services designed to connect users seeking Business-Purpose / Agricultural-Purpose Financing with Lender Partners.

AgLoans is NOT:

  • a lender, creditor, or funding source;
  • a loan originator, mortgage loan originator, or mortgage broker;
  • a loan servicer;
  • an underwriter or credit decision-maker;
  • a consumer reporting agency;
  • your agent, fiduciary, financial advisor, or attorney.

AgLoans does NOT:

  • originate, fund, or service loans;
  • underwrite loans, evaluate creditworthiness, or make credit decisions;
  • set, quote, negotiate, lock, or guarantee interest rates, points, fees, or loan terms;
  • issue commitments, pre-approvals, approvals, or denials of credit;
  • sign, execute, or countersign loan documents;
  • hold, receive, transmit, escrow, or safeguard borrower funds;
  • owe you any duty to obtain financing for you.

Any information about loan programs, typical structures, or general market conditions presented on the Site is educational and illustrative only and is not an offer, quote, or representation of what any Lender Partner will provide to you.

3. Scope of Services; Nature of Document Preparation

Our services may include: reviewing an Inquiry for general fit with Lender Partner program parameters; providing educational content about agricultural financing; collecting documents you provide or authorize us to collect; organizing those materials into a Lender-Ready Package; and transmitting your information and materials to one or more Lender Partners.

You acknowledge and agree that document collection, organization, formatting, and transmission are administrative and clerical services performed at your direction and for your convenience. These services do not constitute underwriting, credit analysis, loan origination, loan brokering, the offering or negotiating of loan terms, or the rendering of legal, tax, accounting, or financial advice. AgLoans does not verify, audit, certify, or attest to the accuracy, completeness, or authenticity of any document you provide.

Services and availability may vary by state, loan type, property type, and Lender Partner program, and may change or be discontinued at any time.

4. Not a Loan Application; No Offer, Quote, or Commitment

Submitting an Inquiry through the Site is not a loan application with AgLoans. AgLoans has no ability to approve, decline, condition, price, or fund any loan.

Nothing on the Site and nothing communicated to you by AgLoans constitutes:

  • an offer or commitment to lend;
  • a quote, rate lock, pre-qualification, pre-approval, or approval;
  • a representation that any Lender Partner will extend credit to you; or
  • a representation regarding the rates, terms, fees, amount, structure, or timing of any financing.

All financing is subject to the applicable Lender Partner's own application process, underwriting, documentation requirements, appraisal, title, credit review, and final approval. Rates, terms, and eligibility are determined solely by the Lender Partner.

5. Eligibility; Intended Use; Business-Purpose Representation

The Site is intended solely for Business-Purpose / Agricultural-Purpose Financing. The Site is not intended for, and must not be used to seek, consumer-purpose residential mortgage loans or any other consumer credit.

By using the Site, you represent and warrant that:

  1. you are at least 18 years old and capable of forming a binding contract;
  2. your Inquiry relates to Business-Purpose / Agricultural-Purpose Financing and not to credit primarily for personal, family, or household purposes;
  3. all information you provide is true, accurate, current, and complete to the best of your knowledge;
  4. you are authorized to seek financing with respect to any property, entity, or operation described in your Inquiry; and
  5. you have authority to submit information on behalf of any entity you represent and to bind that entity to these Terms.

If your financing need is for personal, family, or household purposes, do not submit an Inquiry through the Site.

6. Routing Authorization; Sharing With Lender Partners

When you submit an Inquiry, you authorize AgLoans to:

  1. use your information for intake, evaluation of general program fit, package preparation, and routing purposes;
  2. share your information and any documents you provide with one or more Lender Partners, Referral Partners involved in your Inquiry, and service providers, so that they may contact you and, if applicable, invite you to complete their own application process; and
  3. contact you and follow up regarding your Inquiry as described in Section 12.

You may withdraw this authorization on a going-forward basis by contacting us at legal@agloans.com, but we cannot retrieve or recall information already transmitted to a Lender Partner.

7. No Responsibility for Lender Partners or Referral Partners

Lender Partners and Referral Partners are independent third parties. AgLoans does not control and is not responsible for their licensing, registration, regulatory compliance, underwriting standards, credit decisions, offers, pricing, disclosures, servicing, performance, data security, privacy practices, communications, or any other act or omission.

Any financing relationship, application, or contract is solely between you and the applicable Lender Partner. AgLoans is not a party to it. Inclusion of a Lender Partner in our network is not an endorsement, recommendation, certification, or warranty of that Lender Partner, and does not mean their terms are the best available to you. You are solely responsible for evaluating any Lender Partner and any financing option, and for shopping the market as you see fit.

8. Credit Information and Credit Reports

AgLoans does not obtain, pull, or purchase consumer or business credit reports as part of the Site's intake process, and does not make credit decisions.

Any credit score, credit history, income, debt, collateral value, or loan-to-value figure you provide through the Site is self-reported by you and unverified by AgLoans. Any credit report or credit inquiry will be obtained by a Lender Partner under its own authorization, disclosure, and permissible-purpose procedures, separate from these Terms.

AgLoans is not a consumer reporting agency, and no output, summary, score, tier, or profile generated by AgLoans is a consumer report, an investigative consumer report, or a credit score.

9. Declining or Not Routing an Inquiry

AgLoans may decline to route, or may discontinue routing, any Inquiry at its sole discretion and for any lawful reason. Common reasons include: the request appears to be for a consumer purpose; the loan type, property type, collateral, or geography falls outside the parameters of our current Lender Partner programs; insufficient equity or documentation relative to program parameters communicated to us by Lender Partners; incomplete or inconsistent information; suspected fraud or misrepresentation; or the absence of a Lender Partner that we believe may have interest.

A decision by AgLoans not to route an Inquiry is a business and program-fit decision. It is not a credit decision, an application denial, an adverse action, or a determination of your creditworthiness, and it should not be interpreted as one. AgLoans has no authority to approve or deny credit. Nothing prevents you from applying directly to any lender, or from seeking financing through any other source, at any time.

10. No Advice; No Reliance; Educational Content

The Site may include articles, guides, e-books, blog posts, videos, checklists, and similar materials for general educational purposes. AgLoans does not provide legal, tax, accounting, investment, appraisal, insurance, or financial advice, and nothing on the Site should be relied upon as such or as a substitute for professional counsel.

Agricultural lending involves tax, estate, entity-structure, water-rights, environmental, and land-use considerations that are specific to your situation and jurisdiction. Consult a qualified attorney, CPA, tax advisor, and lender before making any financing or property decision. You are solely responsible for evaluating any financing option and its risks.

11. Calculators, Estimates, and Illustrative Tools

Any calculator, estimator, payment schedule, amortization table, or similar tool on the Site produces estimates for general illustration only, based entirely on assumptions and inputs you supply.

These outputs are not an offer, quote, pre-qualification, pre-approval, or commitment to lend, and do not reflect any specific Lender Partner's rates, terms, fees, or eligibility standards. They generally exclude property taxes, insurance, origination and closing costs, escrows, and other charges. Actual rates, terms, and payments are determined solely by the Lender Partner based on its underwriting, credit review, and collateral eligibility. Verify all figures with a lender before relying on them.

12. Communications; Consent; Calls, Texts, and Email

By providing your contact information, you agree that AgLoans, and Lender Partners and Referral Partners to whom your Inquiry is routed, may contact you at the telephone number(s), email address(es), and mailing address you provide — including by live call, prerecorded or artificial voice message, automatic telephone dialing system, email, and SMS/MMS text message — regarding your Inquiry, its status, financing options, and related services, as further described in the consent disclosures presented at the point of submission and in our Privacy Policy.

  • Consent is not a condition of financing. Consent to receive marketing or autodialed communications is not required as a condition of obtaining financing from any Lender Partner, and is not required to purchase any goods or services.
  • You may revoke consent at any time. Reply STOP to any text message to opt out of SMS; reply HELP for help. Use the unsubscribe link in any marketing email to opt out of email. To opt out of calls, tell the caller or email legal@agloans.com. Revocation may take a reasonable period to process across all systems and does not apply to communications from Lender Partners, which you must address directly with them.
  • Message frequency varies. Standard message and data rates may apply. AgLoans is not responsible for carrier charges.
  • Call recording and monitoring. Calls with AgLoans may be recorded or monitored for quality, training, and compliance purposes where permitted by law. If you do not consent to recording, tell us at the start of the call.
  • Contact hours. We endeavor to contact you only during hours permitted by applicable federal and state telemarketing law.

13. Fees and Compensation; No Borrower Fees

AgLoans does not charge borrowers any fee. We do not charge application fees, intake fees, packaging fees, processing fees, retainers, advance fees, or success fees to borrowers or prospective borrowers for use of the Site or for the services described in these Terms.

AgLoans may receive compensation from Lender Partners in connection with marketing, lead generation, or referrals. Such compensation may create a financial incentive for AgLoans, and you should evaluate any financing option on its own merits. To the maximum extent permitted by law, you agree that any compensation arrangement between AgLoans and a Lender Partner does not create any duty for AgLoans to route your Inquiry to any particular Lender Partner, to route it to the Lender Partner offering the most favorable terms, or to survey the full market on your behalf.

If AgLoans ever intends to charge you a fee, that fee will be clearly disclosed to you in writing, and separately agreed to by you, before it is incurred. No fee is owed by you under these Terms.

14. Electronic Records and Signatures

You consent to transact business with AgLoans electronically and to receive these Terms, our Privacy Policy, consent disclosures, notices, project data, financial information and other communications in electronic form. You agree that your electronic submissions, checkbox acceptances, and typed names constitute your signature and have the same legal effect as a handwritten signature.

To access and retain electronic records you need a device with internet access, a current web browser, and a valid email address. You may withdraw consent to electronic delivery by emailing info@agloans.com, but doing so may prevent us from providing services to you.

15. User Responsibilities; Prohibited Conduct

You agree not to:

  • use the Site for any unlawful purpose or in violation of applicable law;
  • submit false, misleading, incomplete, fraudulent, or unauthorized information, including another person's information without authority;
  • use the Site to seek consumer credit or to disguise a consumer-purpose request as a business-purpose request;
  • interfere with the Site's security or operation, including introducing malware, scraping, harvesting, probing, or reverse engineering;
  • use automated means, bots, or scripts to access the Site without our written permission;
  • impersonate any person or entity or misrepresent your affiliation; or
  • resell, republish, or commercially exploit Site content without our written permission.

16. Third-Party Sites, Content, and Advertising

The Site may contain links to, advertisements for, or content from third parties, including Lender Partners and affiliated properties. Such links and advertisements are provided for convenience and do not constitute an endorsement, verification, or warranty. AgLoans is not responsible for third-party sites, content, products, services, privacy practices, or advertising claims. Your dealings with third parties are solely between you and that third party.

17. Intellectual Property; Limited License

The Site and its content — including text, graphics, logos, marks, calculators, tools, downloadable materials, and compilations — are owned by AgLoans or its licensors and protected by intellectual property laws. Subject to these Terms, AgLoans grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site for its intended personal or internal business purpose. All rights not expressly granted are reserved.

If you believe content on the Site infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to info@agloans.com.

18. Submissions; Confidentiality; Security

While we employ reasonable administrative, technical, and physical safeguards, no online system or method of transmission is perfectly secure, and we cannot guarantee absolute security. Do not submit information you would not want shared as described in these Terms and our Privacy Policy, and do not transmit sensitive identifiers such as Social Security or Tax ID numbers through unsecured email.

You are responsible for maintaining the confidentiality of any credentials and for all activity conducted under your account, if any. You explicitly release AgLoans of any liability in regards to confidentiality, document security, data breach or other information breaches.

19. Use of Artificial Intelligence in Submission Evaluation

By submitting information through the Site, you acknowledge and agree that AgLoans may use automated tools and artificial intelligence ("AI") technologies to assist in processing, reviewing, and organizing your Submission, including to:

  • analyze the information you provide to assess general fit with available Lender Partner programs;
  • generate a preliminary summary or profile of your financing inquiry;
  • assist AgLoans staff in identifying which Lender Partners to approach; and
  • improve the accuracy and efficiency of our intake, document organization, and routing processes.

AI-assisted evaluation is a tool that supports — and does not replace — human review by AgLoans staff. No financing decision, credit decision, underwriting determination, or loan commitment is made by AgLoans, whether by automated means or otherwise. All routing decisions are reviewed by a human AgLoans team member before any substantive action is taken on your Submission. AgLoans does not employ underwriters; any underwriting review is performed solely by the applicable Lender Partner.

Your information is processed in accordance with our Privacy Policy. We do not sell your personal information to third parties, and we do not use your Submission to train publicly available AI models. Questions about our use of AI may be directed to info@agloans.com.

20. Disclaimers

THE SITE AND ALL CONTENT, TOOLS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGLOANS DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.

AGLOANS DOES NOT WARRANT OR GUARANTEE THAT: (A) YOUR INQUIRY WILL BE ROUTED TO ANY LENDER PARTNER; (B) YOU WILL BE CONTACTED BY ANY LENDER PARTNER; (C) YOU WILL RECEIVE ANY LOAN OFFER; (D) ANY OFFER WILL BE ON FAVORABLE OR COMPETITIVE TERMS; (E) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR (F) ANY CONTENT, ESTIMATE, OR CALCULATION WILL BE ACCURATE, COMPLETE, OR CURRENT.

21. Assumption of Risk; Release

YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SITE AND YOUR DEALINGS WITH LENDER PARTNERS, REFERRAL PARTNERS, AND OTHER THIRD PARTIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AGLOANS AND ITS AFFILIATES, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS FROM ANY AND ALL CLAIMS, DEMANDS, AND DAMAGES ARISING OUT OF OR RELATED TO THE ACTS OR OMISSIONS OF LENDER PARTNERS, REFERRAL PARTNERS, OR OTHER THIRD PARTIES.

22. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL AGLOANS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; FOR ANY LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITY, LOST DATA, OR LOSS OF GOODWILL; OR FOR ANY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, ANY DELAY OR FAILURE TO ROUTE AN INQUIRY, OR ANY DEALINGS WITH LENDER PARTNERS OR REFERRAL PARTNERS — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGLOANS' TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE AMOUNT AGLOANS ACTUALLY RECEIVED FROM A LENDER PARTNER IN CONNECTION WITH YOUR INQUIRY IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations or exclusions; in those jurisdictions, the above applies to the fullest extent permitted by law.

23. Indemnification

You agree to indemnify, defend, and hold harmless AgLoans and its affiliates, members, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, judgments, penalties, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • (a) your use of the Site;
  • (b) your violation of these Terms;
  • (c) your Submissions or any information or document you provide, including any inaccuracy or misrepresentation;
  • (d) your representation that your Inquiry is for a business or agricultural purpose;
  • (e) your interactions or dealings with Lender Partners or Referral Partners; or
  • (f) your violation of applicable law or the rights of any third party.

24. Dispute Resolution; Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Informal resolution first. Before initiating arbitration, you agree to contact us at legal@agloans.com with a written description of the dispute and to attempt in good faith to resolve it informally for at least thirty (30) days.

Binding arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any dealings between you and AgLoans will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its applicable rules. The arbitration will take place in Johnson County, Kansas, unless the parties agree otherwise, and the arbitrator's award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.

CLASS ACTION WAIVER: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND AGLOANS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION.

The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim shall proceed in court and be severed from any arbitration.

Exceptions. Either party may bring an individual action in small claims court, and either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction to prevent irreparable harm (for example, misuse of intellectual property or unauthorized access). Nothing in this section prevents you from filing a complaint with a government agency.

30-day opt-out. You may opt out of this arbitration and class waiver provision by sending written notice within thirty (30) days of first accepting these Terms to legal@agloans.com, stating your name, mailing address, email address, and a clear statement that you opt out of arbitration. Opting out will not affect any other provision of these Terms.

25. Governing Law; Venue

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-laws rules. Subject to Section 24, any action not subject to arbitration shall be brought exclusively in the state or federal courts located in Johnson County, Kansas, and you consent to the personal jurisdiction and venue of those courts.

26. Termination; Suspension; Refusal of Service

AgLoans may suspend or terminate your access to the Site, or decline or discontinue service, at any time and for any lawful reason, including suspected fraud, misrepresentation, abuse, compliance concerns, or violation of these Terms — with or without notice. You may stop using the Site at any time.

27. Force Majeure

AgLoans will not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, severe weather, drought, fire, flood, epidemic, war, terrorism, labor disputes, supply or utility failures, interruptions in internet or telecommunications service, cyberattack, or governmental or regulatory action.

28. Changes to These Terms

AgLoans may modify these Terms at any time by posting an updated version with a revised "Last Updated" date. Changes are effective upon posting. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. For material changes, we will use commercially reasonable efforts to provide additional notice. If you do not agree to a change, stop using the Site.

29. Miscellaneous

  • Severability: If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions remain in full force and effect.
  • No Waiver: Failure to enforce any provision is not a waiver of that or any other provision.
  • Assignment: You may not assign these Terms without AgLoans' prior written consent. AgLoans may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
  • No Third-Party Beneficiaries: Except for the released and indemnified parties identified in Sections 21 and 23, these Terms create no third-party beneficiary rights.
  • Headings: Headings are for convenience only and do not affect interpretation.
  • Entire Agreement: These Terms, our Privacy Policy, and any consent disclosures presented at submission constitute the entire agreement regarding your use of the Site and supersede prior agreements on that subject.
  • Survival: Sections 2, 4, 7, 8, 9, 10, 11, 13, and 15 through 29 survive termination.
