AgLoans.com LLC ("AgLoans," "we," "us," or "our") values your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit or use our website and related services (the "Services").
Important note: AgLoans is not a bank. We help gather information and, at your direction, may organize and share it with participating lenders and related service providers to evaluate potential financing options.
1. Scope and Acceptance
By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, do not use the Services.
This Privacy Policy applies to information collected online through the Services and through our communications with you relating to the Services.
2. Information We Collect
We may collect the following categories of information:
A. Information you provide to us
Depending on what you submit, we may collect:
- Contact information (name, email, phone, mailing address)
- Business and farm information (entity name, property details, operations details)
- Financial information you choose to submit (income, expenses, assets, liabilities, credit-related information, tax documents, bank statements, financial statements, and other supporting documentation)
- Identifiers (e.g., government-issued ID numbers) only if requested for underwriting or verification purposes
B. Information collected automatically
When you visit the Services, we may collect:
- Device and usage data (IP address, browser type, pages viewed, timestamps, referring URLs)
- Cookie/analytics data (to help operate, secure, and improve the Services)
C. Information from third parties
We may receive information from:
- Lenders/banks and their service providers in connection with evaluating your inquiry
- Fraud-prevention/security vendors and identity verification services (if used)
- Analytics and advertising partners (limited to online identifiers and usage data, where applicable)
3. How We Use Information

- Provide and operate the Services and respond to inquiries
- Collect, organize, and prepare information for review by lenders/banks (at your direction)

- Improve the Services, including troubleshooting and security monitoring

4. How We Share Information
We do not sell your nonpublic personal information for money.
We may share information in the following circumstances:
A. With lenders/banks and financing partners
At your direction, we may share the information you submit with one or more lenders/banks (and their processors) for evaluation, underwriting, or related financing workflows.
B. With service providers (processors)
We use vendors to help operate our Services (e.g., form processing, secure hosting, document collection, analytics, communications). These vendors are permitted to process information only to provide services to us and must protect it consistent with contractual obligations and applicable law. (Financial institutions are expected to oversee service providers that handle customer information.)
C. For legal, safety, and compliance purposes
We may disclose information to:
- comply with law, regulation, legal process, or governmental requests;
- protect rights, safety, and security of AgLoans, users, and others;
- detect, prevent, or address fraud, security, or technical issues.
D. Business transfers
If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to appropriate confidentiality protections.
5. Security Measures
We implement administrative, technical, and physical safeguards designed to protect information. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.
Use of Cognito Forms (intake forms)
We use Cognito Forms to securely collect intake information. Cognito Forms represents that it undergoes SOC 2 Type II audits, is hosted on Microsoft Azure, and uses TLS (encryption in transit) and AES (encryption at rest) to protect submissions. This intake technology is one component of our broader security approach; we also use access controls, least-privilege permissions, and monitoring practices appropriate to our operations.
6. Data Retention
We retain information for as long as reasonably necessary to:
- provide Services;
- complete the evaluation and communication process;
- comply with legal obligations and resolve disputes; and
- enforce agreements.
We may delete or de-identify information when it is no longer needed. Retention periods may vary depending on the sensitivity of the information, legal requirements, and our relationship to any lender/bank workflow.
7. Your Choices
Communications
You may opt out of promotional emails by using the unsubscribe link in those emails. We may still send transactional or service-related messages.
Cookies/Analytics
Your browser settings may allow you to manage cookies. Some features of the Services may not function properly without cookies.
8. State Privacy Rights (US)
Depending on your state of residence, you may have rights to request access to, correction of, deletion of, or information about certain personal data processing. We will honor applicable rights as required by law, subject to certain exceptions (including where information is subject to financial privacy laws or retained for legal/compliance purposes). Federal financial privacy requirements can apply to financial businesses and may provide different notice/opt-out rules in certain contexts.

9. Children's Privacy
The Services are not intended for children under 13 (or under 16 where applicable). We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will take appropriate steps to delete it.
10. Accuracy, Site Use, and No Professional Advice
We try to keep the Services accurate and up to date, but information on the Services may contain errors or omissions. The Services are provided for general informational purposes and do not constitute legal, tax, or accounting advice. Any decisions based on information provided through the Services are at your own discretion.
11. Disclaimers and Limitation of Liability (Privacy-Related)
To the fullest extent permitted by law:
- We disclaim warranties of any kind regarding the Services, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We are not responsible for the acts of third parties (including lenders/banks or other service providers) once information is shared consistent with your direction and this Privacy Policy.
- We will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to the Services or this Privacy Policy.
Some jurisdictions do not allow certain limitations; in those cases, these limitations apply to the maximum extent permitted by law.
12. Dispute Resolution; Arbitration; Class Action Waiver
Note: Most competitors place arbitration/class-action language in Terms of Use rather than the Privacy Policy. The following provisions are included for comprehensive coverage.
(a) Informal Resolution First
Before initiating a formal claim, you agree to contact us at info@agloans.com and provide a brief description of the dispute and your contact information.
(b) Binding Arbitration
Any dispute arising out of or relating to this Privacy Policy or the Services will be resolved by binding arbitration administered by [AAA/JAMS] under its rules, rather than in court, except that either party may seek injunctive relief to protect intellectual property or prevent unauthorized access.
(c) Class Action Waiver
You agree to resolve disputes with AgLoans only on an individual basis and waive any right to bring or participate in a class action, class arbitration, or representative action.
(d) Governing Law
This Policy is governed by the laws of Kansas, excluding conflict-of-law rules.
